Agreement
The rights and obligations of the parties under Consumer Protection Law and the Distance Contracts Regulation are set out below.
1. Parties

1.2. BUYER INFORMATION
Refers to the real or legal person ("Buyer") who registers as a member of the AskHediyem platform, uses the website, and purchases a service. The information declared by the Buyer during registration or purchase is taken as the basis.
2. Subject of the Agreement
The subject of this Agreement is to determine the rights and obligations of the parties, pursuant to Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale, price, and delivery of the surprise-website-building software services (SaaS), membership packages, and additional digital services offered by the Seller to the Buyer through the AskHediyem website.
3. Product/Service and Payment Covered by the Agreement
The service covered by this agreement is a digital membership package that allows the Buyer, for the duration they choose (Weekly, 6-Month, Yearly, etc.), to build interactive, password-protected surprise web pages with music and photos on the AskHediyem platform, and to host and share them on the Seller's servers.
The price of the service, the tax-inclusive amount, and the payment method are as shown to the Buyer on the website's purchase page. Payments are collected via credit or debit card through the Seller's contracted secure payment infrastructure (PayTR).
4. Performance and Delivery Terms
As the purchased service is a software service (SaaS) delivered entirely in a digital environment, no physical product shipment or courier delivery will be made to the Buyer.
Once the purchase transaction is successfully approved by the payment provider, the Buyer's subscription package is automatically activated instantly (within a few minutes at the latest), and the Buyer can log in to the system and start using the service.
5. Rights and Obligations of the Parties
- The Buyer is obligated to upload content that complies with copyright law, morality, and applicable law while using the software provided by the Seller.
- The Seller makes the necessary technical effort for the uninterrupted operation of the system, but cannot be held directly responsible for interruptions caused by server outages, infrastructure failures, or cyberattacks.
- The Buyer undertakes the accuracy of the information (email, etc.) they provide to the system.
6. Right of Withdrawal and Its Exception
Pursuant to Article 15, paragraph 1, clause (ğ) of the Distance Contracts Regulation, the right of withdrawal "cannot be exercised in contracts for services performed immediately in electronic form, or for intangible goods delivered instantly to the consumer".
Since AskHediyem subscriptions are digital services performed immediately upon payment confirmation and delivered instantly to the Buyer, the Buyer has no right of withdrawal or refund. The Buyer has the opportunity to test the system by building and reviewing their site with the live preview tool before making a purchase; payment is only required when the site is to be published.
7. Competent Court
Consumer Arbitration Committees, up to the value announced by the Ministry of Industry and Trade, along with the Istanbul (Çağlayan) Consumer Courts and Enforcement Offices, are authorized to resolve any dispute arising from the implementation and interpretation of this agreement.
This agreement is deemed to enter into force from the moment it is confirmed by the Buyer on the payment page.
